1. Who you are agreeing with

Polyvox is published by HGM LLC, a limited liability company registered in the State of Delaware, United States, at 8 The Green, Suite B, Dover, DE 19901 ("we", "us"). By installing or using Polyvox, or by buying a subscription, you agree to these terms.

2. The software

Polyvox is a Windows desktop application that transcribes speech on your own computer, translates it, and displays the result. We grant you a personal, non-exclusive, non-transferable right to install and use it.

You may not resell Polyvox, redistribute modified copies of it, or remove or work around its licensing. Some components of Polyvox are third-party open source software, and those components are covered by their own licenses, which ship with the application.

3. Subscriptions

A subscription unlocks the Study module, translation through the service we operate, and the AI assistant. Everything else in Polyvox is available without one.

4. How you may use it

Polyvox can transcribe audio your computer is playing, which may include other people speaking. You are responsible for using it lawfully. Recording and consent laws differ by country and by state, and some of them require every participant in a conversation to agree before it may be recorded or monitored.

You agree not to use Polyvox:

We may end a subscription and refuse service if it is being used for any of the above. Where the reason is not your fault, we refund the unused part.

5. Availability of our service

The translation service and the AI assistant depend on servers we run and on providers we buy capacity from. We aim to keep them available, but we do not promise uninterrupted service. If our service is unavailable for an extended period, contact us and we will credit or refund the affected time.

Local transcription does not depend on our servers and continues to work while they do not.

6. Export and sanctions

You may not use Polyvox, or buy a subscription, if you are located in a country or region subject to comprehensive United States sanctions, or if you appear on a United States restricted party list.

7. No warranty

Polyvox is provided "as is". Machine transcription and machine translation are imperfect and will sometimes be wrong in ways that change meaning. Do not rely on Polyvox where an error would be harmful, such as medical, legal, financial, or emergency situations. To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the fullest extent the law allows, our total liability arising out of or relating to Polyvox is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data.

Some jurisdictions do not allow these limits. Where that is the case, the limits apply only as far as that jurisdiction permits, and nothing here removes a right you have as a consumer that cannot be waived.

9. Changes to these terms

We may update these terms. If a change matters to you as a subscriber, we will give notice in the application or by email before it takes effect, and you may cancel before it does.

10. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. The courts of the State of Delaware have jurisdiction, except where the law of your country of residence gives you the right to bring a claim locally.
